How is the estate of a man who left two daughters, a wife, and three sisters to be distributed, and does his paternal uncle have a share in it?
If a man passes away, leaving behind a wife, two daughters, three sisters, and a paternal uncle, and no other heirs, then the wife receives one-eighth (1/8) due to the presence of a lineal descendant, and the two daughters receive two-thirds (2/3). As for the sisters: if they are full sisters or paternal sisters (sisters from the father's side), they inherit the remainder by ta'sib (residuary heirship), and the paternal uncle receives nothing. If some are full sisters and some are paternal sisters, the remainder goes only to the full sisters. If they are maternal sisters (sisters from the mother's side), they do not inherit because they are excluded by the daughters, an exclusion of deprivation, and the remainder then goes to the paternal uncle. It is advisable to refer inheritance matters to the courts for precise investigation, as there may be wills or debts that take precedence over the rights of the heirs.
