What is the ruling of Islamic law concerning a husband who marries another woman and abandons his first wife and daughter, yet does not divorce her, claiming he has not wronged her? And is what is happening a test or a tribulation from Allah?

What has happened to you may be a trial and a test from Allah, and not necessarily a punishment for a sin. Your husband should have appreciated your help, your travel, and your patience during his absence. He must treat you with kindness, as Allah commanded in His saying: "And live with them in kindness." This kind treatment includes fulfilling your rights of dowry and maintenance, and not causing you harm.

We recommend the intervention of wise individuals from your family and his family to advise him to fear Allah regarding you, remind him of your rights, and try to mend the relationship between you to preserve the family. It is your right that he be just between you and his second wife, as justice is obligatory even if the countries of residence differ. If he does not act justly, he is an oppressor, and it is not permissible for him to leave you in suspense. It is either retaining with kindness or releasing with excellence. If reconciliation is not possible, take your case to court.

We note that the husband's statement to his wife, "What is between us is over," is an implicit divorce (kinayah) by which divorce occurs if the husband intended it.
