Does a divorce pronounced by the husband to his wife to convince her to return home, on condition that he divorces her after her menstruation and purification, take effect, knowing that he did not intend divorce by that?

The husband's statement to his wife: "Go back to your home and children for a month until you get your menstruation, then after purification, I will divorce you," does not constitute a divorce, because it is merely a promise of divorce. The divorce does not take effect until the husband actually divorces her after her menstruation.

The marital relationship between spouses must be based on kindness. A husband is not permitted to beat his wife except in cases of her rebellion (nushuz) and her failure to respond to admonition and abandonment in bed. He is not allowed to strike her on the face or to inflict a severe beating, based on the Almighty's saying: (Men are in charge of women by [right of] what Allah has given one over the other and what they spend [for maintenance] from their wealth. So righteous women are devoutly obedient, guarding in [the husband's] absence what Allah would have them guard. But those [wives] from whom you fear rebellion - [first] advise them; [then if they persist], forsake them in bed; and [finally], strike them. But if they obey you [once more], seek no means against them. Indeed, Allah is ever Exalted and Grand.)
