What is the punishment for one who divorces his wife without cause, wrongfully expels her from her home, and falsely swears in court to evade her rights, such as the deferred mahr?
A man divorcing his wife without cause is reprehensible, but he does not incur sin thereby. Expelling the wife from the home after a revocable divorce ( raj'i) is permissible, but after an irrevocable divorce (talaq ba'in), expelling her is unlawful until her ' (waiting period) ends, as Allah Almighty says: "Do not expel them from their houses, nor should they leave, unless they commit a flagrant indecency." A husband denying the deferred dowry (mu'akhkhar al-sadaq) is unlawful and constitutes consuming people's wealth unjustly. His swearing falsely regarding it is a major sin, one of the greatest. The deferred dowry is a fixed right for the wife and is not forfeited except with clear evidence.
