Is it permissible for a divorced woman to financially benefit from the fine determined by the court?

1 min readAlso available in العربية

Divorce without a reason is disliked, and it may even reach the level of prohibition, due to the Prophet's (peace be upon him) saying: "A believing man should not hate a believing woman; if he dislikes one of her characteristics, he will be pleased with another." This is also due to the waste of money involved, the prohibition of harm, and because it is the most disliked of permissible acts. If the husband insists on divorce, there is no fine imposed on him. The divorcing husband is obligated to fulfill the rights established by Sharia, and there is no harm in taking them. However, any fine exceeding these rights is not permissible to take.
