The question

What is the ruling on my remaining with my husband after the head of the Fatwa Committee ruled that only two divorces had occurred, knowing that he lied to and misled the Mufti and the judge, and that he divorced me three times, intending divorce each time? Is my presence with him permissible or forbidden, and will I bear a burden of sin?

The answer

If the matter relates to the husband's intention, where intention is considered, such as in a divorce by ambiguous words (طلاق الكناية), then the husband is most knowledgeable about his intention, and its place is the heart. It cannot be known except from him, as Ibn Qudamah said: "If they differ, and the husband says: 'I did not intend divorce with the words of choosing, and your affair is in your hand,' and she says: 'Rather, you did intend it,' then his word is to be accepted, because he is most knowledgeable about his intention, and there is no way to know it except from him." Based on this, there is no harm in the wife remaining under his marital bond and his cohabiting with her.
