Does the landlord have the right to oblige the tenant to repaint the apartment upon vacating it?

If there was no transgression on the part of the tenant and their use of the apartment was customary, then the landlord is not entitled to demand that the apartment be painted upon handover, because the tenant is a trustee over the leased property and is not liable for it except in cases of transgression. If the lessor stipulated this in the contract, most scholars hold this condition to be void, because it contradicts the essence of the contract. Ibn Qudamah narrated from Ahmad that renting with a guarantee is disliked, and that the jurists of Madinah used to say, "We do not rent with a guarantee," except in clear cases of transgression.
