Is it considered a divorce if the husband says to his wife: "If you want intercourse in the capacity of something else, no problem (as a lover or a friend), but as a husband: no, I am not your husband"?

The husband's statement, "I am not your husband," is not an explicit divorce (talaq sareeh); rather, it is an implicit divorce (kinayah) by which divorce occurs if the husband intended it. So, if he intended divorce by it, it takes effect; but if he did not intend it, it does not take effect. This statement is objectionable and reprehensible, and he must repent from it.
