What is the ruling on someone who says, "O Lord, he does not want his wife"? Is this considered a divorce?

The husband's statement "he does not want his wife" is a metaphorical expression (kinayah) of divorce. If he intended divorce by it, then the divorce takes effect; otherwise, nothing is upon him. If the divorce occurs, he may reconcile with his wife before her waiting period ('iddah) ends (which is her purification from the third menstruation after the divorce, or the passage of three months for one who does not menstruate, or giving birth for a pregnant woman) if this divorce is the first or second. However, if the 'iddah has ended, a new marriage contract must be renewed. If this is the third divorce, then she is forbidden to him and does not become lawful for him unless she marries another husband in a valid marriage and he consummates the marriage with her, and then divorces her.
