What is the ruling on disposing of a trust receipt deposited with an intermediary if it is proven that the wife assaulted her husband verbally or by defamation, knowing that each of them wrote a trust receipt to the other for the same amount?

It is not obligatory for either spouse to pay a sum of money to the other in case of ill-treatment, and this is not legislated in the first place, because the estimation of punishment is not for human beings. Financial chastisement (ta'zeer) is for the ruler. Writing a promissory note to that effect is a lie, and these notes must be disposed of. Spouses should treat each other with kindness and live together in goodness.
