It is permissible for the first tenant to waive their right of priority to rent the premises to another person in exchange for a sum of money, unless the contract concluded between the first tenant and the municipality stipulates otherwise. If the contract stipulates a prohibition, then it must be adhered to, because "Muslims are bound by their conditions." In the absence of such a condition, waiving the right for compensation is considered a form of compensation for rights that have financial value in market custom.
