If the husband conditioned his wife's divorce upon her mistreating him, and she then mistreated him by saying, "May Allah take revenge on him," then the fatwa is that the divorce has occurred due to the husband's breaking of his oath. If he had previously divorced her once, then two divorces have occurred, and only one remains for him. He may take her back before the expiration of her 'iddah without a new contract.

This is what the majority of scholars rule concerning the issue of conditional divorce. Some scholars, such as Ibn Taymiyyah, are of the opinion that if the husband conditioned the divorce with the intention of emphasis or prevention, and not to cause divorce, then it is considered like an oath, and he must pay an expiation for an oath if he breaks it. The spouses must live together in kindness.
