If a man spends his money in obligatory jihad and then death overtakes him, he has done well, and Hajj is not required on his behalf after his death, because Hajj had not become obligatory for him. However, performing Hajj on his behalf as a voluntary act is permissible and encouraged. But if jihad was not obligatory, or if the man had delayed Hajj while he was capable of performing it before jihad became obligatory, then he would be considered negligent, and Hajj must be performed on his behalf from his estate to clear his obligation.
