What is the Shar'i (Islamic legal) and most beneficial opinion for a couple where the husband has not consummated the marriage with his wife for seven years, and each of them claims the other has a defect, and the wife claims to faint and suffer from concussion upon hearing his name or seeing him?

If both spouses have a congenital defect and agree to live together, there is no legal impediment. If one of them has a defect that necessitates the option [to annul the marriage], then he or she may refer the matter to the Sharia (definition) court, unless they were aware of the defect before the contract or consented to it afterwards. Every claimant must prove their claim.

As for what the wife mentioned about her condition upon seeing her husband or hearing his name, she may present this to the court and explain the reason. This problem may only be resolved by Sharia courts or their equivalent.
