Is it permissible to seek divorce (talaq) or annulment (khul') from a husband whose smell the wife cannot bear, with whom she finds no happiness, especially in the marital relationship, and whom she fears might lead her to sin, knowing that he refuses to divorce her?

A wife must fulfill her husband's rights and protect his honor. Mistreating her husband and wronging him does not justify her betrayal or committing adultery, because Islamic law has provided a woman with a way to separate from her husband if she fears she cannot uphold God's limits with him. If the wife is able to be patient and attempt to reform her husband while preserving herself and her husband's trust, that is preferable. Otherwise, she must seek divorce or khul' to safeguard her religion.
