Does divorce occur with the words "It is unlawful and divorce, if you call me and do not answer the phone, then you are divorced" if the wife does not answer the phone while she is asleep, knowing that the husband was angry and only intended to scare her?
If you swore an oath in a state of extreme anger that caused you to lose consciousness, then there is nothing binding upon you. However, if the anger did not cause you to lose awareness, then, according to the majority of scholars, the divorce takes effect if the wife does that which was sworn against. Sheikh al-Islam Ibn Taymiyyah holds the view that an oath of divorce does not result in divorce if the husband did not intend divorce, but rather he is obliged to offer an expiation for breaking an oath.
As for your statement "haram and divorce" without attributing it to your wife, some scholars have considered it an oath, by assuming its attribution to the wife.
This divorce and prohibition do not take effect. What actually takes effect is the conditional divorce. So, if he says, "I swear by triple divorce that if you speak to Zayd, you will be divorced," then only one divorce is binding upon him unless he intended more, because the apodosis of the condition is "you will be divorced." Thus, the triple divorce is not binding upon him unless all the conditions are met.
In this matter, it depends on your intention. If you intended to make the divorce conditional on your wife deliberately not responding, then it does not take effect if she does not respond while she is asleep. But if you intended to make the divorce conditional on her not responding in any state whatsoever, then the divorce has occurred (according to the prevalent opinion). And if it is less than three divorces, you may take her back before the expiration of her iddah.
We advise you to present the matter to the Sharia court or to trustworthy scholars.
