What is the ruling on committing acts of Fusuq (disobedience/wickedness) during Hajj, but not on the Day of Arafah, and is there an expiation for it, or does it invalidate the Hajj?
A Muslim must avoid sins, especially if he is in a state of ihram for Hajj or 'Umrah, based on the Almighty's saying: ﴿Hajj is [during] well-known months, so whoever intends to perform Hajj therein - there shall be no sexual relations, no wickedness, nor disputing during Hajj.﴾
The sins committed by a pilgrim are of two types: 1. Not among the prohibitions of ihram: Repentance and seeking forgiveness are required for these, and they do not affect the validity of the Hajj, but they diminish its reward. 2. Among the prohibitions of ihram: Sexual intercourse (penetration) before the first partial release from ihram (at-tahallul al-awwal): This invalidates the Hajj, according to the preponderant opinion, and one must proceed with it and slaughter a sacrificial animal (hady). Sexual intercourse after the first partial release from ihram (after performing two of three: throwing the pebbles at Jamrat al-'Aqabah, shaving/cutting hair, and performing Tawaf al-Ifadah): The Hajj is valid, and one must slaughter a camel (badanah). Other prohibitions besides sexual intercourse or its مقدمات (preliminaries) and before the first partial release from ihram: These do not invalidate the Hajj, and a ransom (fidyah) is required.
