What is the ruling on one who repeatedly swears an oath of divorce?

Scholars differ regarding the occurrence of divorce when an oath of divorce is made and the condition it was contingent upon is met. The majority of scholars hold that it occurs, whether the divorce was intended or not, and this is the relied-upon position of the four Madhhabs. However, Sheikh al-Islam Ibn Taymiyyah chose the view that it does not occur if one did not intend to make the divorce contingent, but rather intended to encourage or prevent something. We advise against taking an oath by divorce due to the serious implications it entails. The matter should be referred to the Sharia courts or to people of knowledge.
