Is divorce forbidden for one who desires to have children, but his wife refuses on the grounds of the pain of childbirth and offers him marriage to another, while he is unable to do so and fears not being just?

Procreation is a right for both spouses, and neither of them is permitted to abstain from it except for a legitimate Shar'i (Islamic legal) excuse. The pain of childbirth and the usual fatigue are not considered a legitimate Shar'i excuse for abstaining from procreation. It is advisable to continue counseling the wife and reaching an understanding with her, and to seek assistance from those who might influence her. If she insists on refusal and the husband decides to divorce her, he has that right, while considering the negative effects of divorce on the children and exploring the possibility of marrying another woman and treating both justly.
