Is zakat obligatory on grains and fruits from privately owned agricultural lands in Burma, knowing that the government sometimes confiscates them?

Constitutions do not prohibit what is permissible nor permit what is prohibited. Lands that are legally owned by you through purchase or inheritance are your property, not the property of the state. Zakat (definition) on produce must be given from them if they reach the nisab (definition). The farmer (whether a tenant or one who has borrowed the land) pays zakat on what comes out of the land, as he owns this produce, in accordance with the Almighty's saying: "O you who have believed, spend from the good things which you have earned and from that which We have produced for you from the earth." The majority of scholars hold the view that zakat is due from the tenant of the land, not its owner.
