It is not permissible to abort the fetus at all, whether before or after the ensoulment, and there is no difference between a pregnancy resulting from adultery and one from marriage. If an abortion was performed after 40 days, the woman must repent and pay the fetus's blood money (Diyya), which is one-tenth of the mother's blood money. It is more cautious to also perform the expiation (). If the deceased mother had aborted after 40 days, the blood money is taken from her estate unless the heirs pardon it. As for the man who committed adultery with her, he must offer sincere repentance. If the girl was mentally incapacitated, there is no blame upon her.
