Is buying a copy of the Qur'an and placing it in the mosque with the intention of it being a charity on behalf of the deceased, using money that was not handed over to her during her lifetime, considered legally valid in Islam?
The gift must be returned to its owner if the donee dies before acquiring or taking possession of it, because it has become inheritance property. Malik narrated in Al-Muwatta' from Aisha that Abu Bakr, may Allah be pleased with him, had given her twenty wasqs of dried dates. When he fell ill, he said: "O my daughter, I had given you twenty wasqs of dried dates. If you had acquired it or taken possession of it, it would have been yours. But today it is inheritance property, so divide it according to the Book of Allah." Al-Nawawi added that a condition for the gift to become binding is possession, so ownership of the gifted item is not acquired except by taking possession of it. Furthermore, it is not permissible to dispose of it except with the owner's permission, based on the Almighty's saying: "Indeed, Allah commands you to render trusts to whom they are due."
