Is a person afflicted with frequent urination and urinary incontinence, who feels pre-seminal fluid (madhy) exiting when thoughts of women cross his mind or when massaging his limbs during ablution (at least once daily), considered to be in a state of continuous impurity (mustankih) according to the Maliki madhhab (due to urine and madhy), such that he is not required to perform istinja (cleansing) or take precautions, and merely performing ablution for the time of each prayer suffices him, or does the fact that the madhy does not continue for half the prayer time alter this ruling?

The Maliki school of thought clarifies the issue of سلس ( سلس, continuous discharge) and المستنكح بالحدث ( al-mustankah bil-hadath, frequently affected by impurity). For the person with سلس – which is someone who is afflicted by impurity most of the time – he is not obligated to perform ablution for every prayer; rather, it is recommended. The impurity on his body and clothes is excused. As for the المستنكح بالحدث – who is someone afflicted by impurity once a day or more – his impurity nullifies ablution, but its impurity on the body and clothes is excused due to the difficulty of guarding against it. Accordingly, whoever experiences drops of urine most of the time is considered to have سلس. And whoever experiences drops of prostatic fluid at least once, his impurity nullifies ablution, but it is not obligatory to purify it.

This school of thought differs from what the majority of scholars hold, as they maintain that the person with سلس is obligated to perform ablution for the time of each prayer, while taking precautions against the spread of impurity. And whoever's clothes are affected by impurity is obligated to remove it, except in cases of inability.
