What is incumbent upon the husband and wife after they had intercourse while fasting during the daytime in Ramadan on four different days, knowing that the husband was traveling and the wife was a resident?
If breaking the fast is due to a legitimate -approved excuse, then only making up the missed days (qada') is required, without expiation (). However, if it's without a legitimate Sharia-approved excuse, such as sexual intercourse, then merely being newly married is not an excuse. Repentance and making up the missed days are required.
Regarding expiation for sexual intercourse: if the breaking of the fast occurred before intercourse, there is a difference of opinion regarding its obligation, and it is more prudent to pay it. However, if it occurred through intercourse, there is no disagreement regarding its obligation, and it is incumbent upon both the man and the compliant woman. The expiation is required for each day individually.
If travel permits breaking the fast, then only making up the missed days is required. However, the concessions for travel cease with the intention of staying for four days according to the majority of scholars, or by passing through one's homeland, or a town where one has a wife, or if one has family and a home in the town through which one passes.
