Is the validity of the Hajj affected by what happened, by way of intentional bodily contact between spouses during the circumambulation (Tawaf) due to overcrowding?
If the physical contact with the husband involved a barrier that prevented skin-to-skin contact, and nothing was discharged, then there is no consequence for the woman. However, if this occurred during the state of , she must seek forgiveness and repent. If it led to the discharge of maniy (semen/vaginal fluid) or madhiy (pre-ejaculatory fluid) and was not during the state of Ihram, then the (circumambulation) is invalidated. If it was the tawaf al-wada' (farewell circumambulation) and was not repeated, then a dam (sacrificial animal) is required.
As for physical contact with desire during tawaf al-ifadah (circumambulation of overflowing) or tawaf al-qudum (arrival circumambulation) while in the state of Ihram, and it involved skin-to-skin contact without a barrier, it is prohibited and necessitates a dam, whether anything was discharged or not.
If the physical contact involved a barrier, it is also prohibited, but it does not necessitate a dam. However, if maniy or madhiy was discharged, then the tawaf is invalid according to the majority of scholars.
The tawaf al-ifadah cannot be compensated for by a dam. A woman who performs it while not in a state of ritual purity remains in her state of Ihram until she returns and performs it. It is permissible to adopt the view of some scholars who say that a dam is sufficient for her as compensation for the lack of purity.
