Is it permissible for four women to divide their mother's gold among themselves without the three men?

It is not clear to us when the daughters took the gold from the mother, and whether it was with her consent as a gift (hiba) or a loan (ariya), because that affects the fatwa (definition). The mere silence of the mother regarding her daughters' actions and their division of her gold is not considered an explicit gift, as the principle is that silence is not considered permission unless there are indications of consent. If this occurred during the mother's death illness (marad al-mawt), then it falls under the ruling of a bequest (wasiya), and there is no bequest for an heir.
