Is it obligatory to stay overnight with a woman who has been irrevocably divorced after the discovery of her pregnancy subsequent to the completion of her iddah from the first divorce, and is the husband sinful if he stays overnight with her every day?
A woman who is revocably divorced is considered to be like a wife. It is permissible for her husband to be alone with her, to spend the night with her, and to travel with her. This is the preponderant opinion according to us. Therefore, there is no sin upon the husband if he spends the night with his revocably divorced wife during her 'iddah (waiting period). Spending the night is not obligatory upon him.
It is advisable to reconcile whenever possible, due to the severe consequences of divorce, especially for children. It must be noted that the waiting period for a pregnant woman ends upon childbirth, and a woman is not permitted to seek a divorce except for a legitimate Shar'i reason.
