Is it permissible to give a portion of zakat to one of the partners in an agricultural land if they are eligible for it, such as the deceased uncle's wife who works to earn money?
According to the majority of scholars, the zakat on date palm fruit is obligatory in kind, not in cash. The time it becomes obligatory is when the fruit shows signs of ripening, by turning red or yellow. After this point, the owner is not permitted to dispose of the fruit before its estimation (kharṣ) and the extraction of zakat from it. The owner may seek assistance from estimators to assess the quantity of dates after drying, and zakat is obligatory on this estimated quantity. If the owner sells the fruit, he must give the zakat in dates, according to the obligatory amount. The minimum taxable amount (niṣāb) for dates is five wasqs, which is approximately 825 kilograms. The share of the deceased uncle devolves to all his heirs. If his wife is poor and her share is insufficient for her needs, it is permissible to give her from the zakat.
