Is it permissible to marry a girl whose family refuses to marry her to a Muslim, while her mother prefers to marry her to a non-Muslim, knowing that the girl is steadfast in her religion and wishes to marry the Muslim? And can the judge be her legal guardian in this case?

It is not permissible for a Muslim to have an emotional relationship with a woman who is a stranger to him. If a man's heart is afflicted with love for a woman, the best remedy is to marry her, for the Prophet, peace and blessings be upon him, said: "There is nothing better for two who love each other than marriage." If the girl is religious and of good character, then one should strive to marry her. Her guardian should arrange her marriage. If the guardian refuses without a legitimate Shar'i reason, the girl may refer her case to the Sharia court. The girl should avoid and emigrate from corrupt environments, especially if she fears for her faith. The mother has no guardianship over matters of marriage and her obedience is not obligatory in preventing her daughter from marrying a suitable man. A girl's mother's denial of Paradise and Hell, and of the words of Allah and His Messenger, is considered clear disbelief. It is obligatory to advise her and remind her of Allah.
