What is the ruling of Islamic law concerning the situation of a man whom the positive law of his country prevents from polygamy, which leads him to abandon prayer, divorce his first wife, or marry secretly?

Polygyny is originally permissible and may be obligatory, commendable, forbidden, or disliked. If polygyny is obligatory but the man is unable to marry, he incurs no sin for not doing so, and he must remain chaste and avoid fornication. A Muslim has no excuse to abandon prayer, no matter what sins he commits, and prayer prohibits indecency and evil. Secret marriage is permissible, and it is not a condition to inform the first wife about the second. Divorce is not an injustice if there is a legitimate Shariah reason for it. However, if the wife stipulates that her husband not marry another, and the husband agrees, then the correct view is that fulfilling this condition is binding.
