What is the ruling on a husband withholding his wife's marital rights for a month, despite knowing her need for them, and claiming fatigue from work, even though he is neither ill nor incapacitated?
A husband must treat his wife kindly, and this includes her right to conjugal relations. He is not permitted to abandon this right except for a legitimate Shar’i excuse. Scholars have differed regarding the obligation of sexual intercourse, and the correct view is that it should be according to the the wife's need and the husband's ability. The wife should gently and kindly explain her right to her husband. If he insists on abstaining, she should inform his relatives who have influence over him. It is advisable to be patient as long as the wife does not fear falling into haram (unlawful acts). If she fears this, then she has the right to seek a divorce.
