Does the Sharia Court order advice first when the wife requests a divorce and refuses mediation and admonition, or does it convene the hearing court directly? And how can one reconcile the hadith: "Any woman who asks her husband for divorce without any real cause will be forbidden the scent of Paradise" with the hadith of the wife of Thabit ibn Qays who sought khul' from the Prophet, peace and blessings be upon him?

A woman has the right to request a divorce in specific situations, such as ill-treatment by the husband, or her intense dislike of him to the extent she fears neglecting his rights, or due to his ugliness and her fear of falling short in fulfilling his rights, or due to his lack of religious commitment or character, or her inability to live with him. In these cases, she is permitted to seek a khul' (divorce initiated by the wife) by returning the dowry the husband gave her. However, requesting a divorce without a valid reason is forbidden.
