Scholars differ regarding the Aqiqah for a miscarried fetus. Some believe it is not prescribed, while others hold that it is prescribed if the fetus has reached four months and the soul has been breathed into it, because it will be resurrected on the Day of Judgment and its intercession will benefit its parents. As for praying over it, it is prescribed if it has reached four months; it should be washed and prayed over. Indeed, Ibn Umar prayed over his daughter's child who was stillborn. Evidence for this is drawn from the Hadith of Mughirah ibn Shu'bah, that the Prophet, peace and blessings be upon him, said: "The miscarried fetus is prayed over, and forgiveness and mercy are supplicated for its parents." If the miscarried fetus is buried without prayer, it is permissible to pray over its grave for up to a month. A miscarried fetus is not circumcised after death, because no one is circumcised after death.
