The question

Is it obligatory to perform the 'aqiqah and naming for a female infant who died in the womb after seven months of gestation? And is what the husband did regarding washing, shrouding, praying over, and burying her correct? And can the mother perform the 'aqiqah for her after her divorce?

The answer

Patience in the face of divine decree and contentment with Allah's destiny are among the stations of the righteous and the near ones. The best way to receive an affliction is by saying, "Praise be to Allah; indeed we belong to Allah, and indeed to Him we will return." The Prophet (peace be upon him) gave glad tidings that the reward for one who loses a child and endures patiently and seeks reward from Allah is the construction of a house for him in Paradise called "the House of Praise." Furthermore, the death of a child or a miscarriage serves as a shield from Hellfire if the mother seeks reward from Allah for it.

Scholars have unanimously agreed that if a child's life is known and it cries out upon birth, it should be washed, shrouded, and prayed over. As for one who does not cry out, the consideration is the insufflation of the soul into it after four months. If the soul has been breathed into it, it should be washed, shrouded, and prayed over; otherwise, not.

Scholars have differed regarding the permissibility of performing the aqiqah (sacrificial offering) for a miscarriage if it has reached four months. Some have inclined towards its desirability and that it should be named. The aqiqah is the responsibility of the father; if he refrains or gives permission to the mother, it is permissible for her to do so. Therefore, what the husband did—washing, shrouding, and praying over the miscarriage—is permissible. What remains is naming it and performing the aqiqah for it.
