Does guardianship fall away from a husband who does not work due to laziness, suffers from schizophrenia, mistreats his wife, and claims that the Messenger, may Allah bless him and grant him peace, said: "Women, then women, then women, then Jews and Christians first"?

This statement attributed to the Prophet, peace and blessings be upon him, has no basis; it is false and reprehensible. The Sharia has elevated the status of women and enjoined men to treat them kindly. If the husband abuses the marital relationship with insults and degradation, he is an oppressor. The wife has the right to refer his case to the judge, who can admonish him or order him to divorce her. It is not permissible to remain silent if he repeatedly divorces her; she must refer the matter to the Sharia court.
