Whoever touches perfume before exiting the state of ihram from 'Umrah forgetfully, is considered like one who forgets. Scholars have differed regarding the necessity of expiation (fidyah) upon him. Malik, Al-Layth, Abu Hanifa, and Al-Thawri held the view that expiation is necessary, and this is one of two narrations from Al-Shafi'i and Ahmad. Al-Shafi'i and Ahmad, in the other narration, which was chosen by Ibn Taymiyyah and Ibn 'Uthaymeen, held the view that expiation is not necessary. The first opinion (that expiation is necessary) is more cautious and more absolving of responsibility. The expiation is fasting for three days, or feeding six needy persons, or sacrificing a sheep.
