What is the ruling on doubt regarding a wife's statement "You are drunk," if the husband swore an oath of divorce that she prove it to him, and she does not remember?

Divorce does not occur if there is doubt about the fulfillment of the condition upon which it was made contingent. So, if the husband swears to divorce his wife contingent on her proving his intoxication, and she fails to prove it, then the divorce takes effect. The husband has the right to take his wife back after the first or second divorce, as long as she is still within her waiting period (iddah).
