Is it permissible to agree to plant a person's land with olive trees and carry out all services at the landowner's expense, in exchange for receiving half of the fruit at harvest season?

Scholars have differed on the permissibility of leasing land for a portion of its produce. Al-Thawri, Al-Layth, and others held it permissible, citing as evidence the Prophet's arrangement with the people of Khaybar, where he dealt with them for half of what the land produced. In contrast, Al-Shafi'i, Malik, and Abu Hanifa deemed it impermissible, arguing that it is a rent paid with an unknown عوض (counter-value). The preponderant opinion is that of permissibility, due to the strength of the evidence presented by those who allow it.
