Do the sons of the deceased man inherit from his wife, who is their paternal aunt through رضاعة (nursing), or is their marriage invalid to begin with?
If a man's father was suckled by the woman's mother five times within two years, then the woman becomes the man's paternal aunt through suckling (rada'a), and it is forbidden for him to marry her. If the marriage has taken place, it must be annulled immediately. Continuing in it, while being aware of the prohibition, is a grave sin and a void marriage (nikah batil). In this case, the children are not attributed to the husband according to the majority of scholars, because the marriage is unanimously considered void. However, some scholars hold that paternity is established due to the semblance of a contract (shubhat al-aqd). Paternity is established in marriages where there is a difference of opinion (such as marriage without a guardian), and also in marriages that are unanimously agreed to be void (such as marriage to maharim) if there is a semblance of doubt that negates the punishment (such as ignorance of the prohibition). However, if the man was aware of the prohibition, the child is not attributed to him according to the majority of scholars. Abu Hanifa, however, held that paternity is established in all cases due to the semblance of a contract. Abu Yusuf and Muhammad are of the opinion that paternity is not established in the case of a permanently forbidden woman if the marriage is unanimously agreed to be unlawful. The matter should be referred to the judiciary to establish the suckling and to rule on paternity and its related consequences.
