Does a divorce pronouncement uttered by a husband while in a state of extreme psychological distress, and intended for intimidation and discipline rather than separation, count as a divorce?

It is advisable to consult the Sharia (definition) Court or ask people of knowledge. Jurists have differed regarding the ruling on divorcing a menstruating woman. The majority opinion is that it occurs, unlike some scholars such as Ibn Taymiyyah. Mere psychological pressure from the wife does not prevent the occurrence of divorce. An explicit divorce takes effect, and the intention of disciplining is not considered. It is not permissible for a husband to abandon his wife or deprive her of her rights except for a legitimate Shar'i reason.
