Is a divorce pronounced by a husband valid, whom his wife surprised by demanding a divorce during his deep sleep, so he awoke startled and said to her: "You are divorced"?
If a man's astonishment reaches a degree where he does not comprehend what he is saying, his divorce does not take effect, based on the Prophet's (peace be upon him) saying: "There is no divorce in a state of closure (إغلاق)." And whoever reaches this state is considered as if insane. However, if he comprehends what he is saying at the time of divorce, then the divorce takes effect, and he may take her back during her 'iddah (waiting period) if this divorce is the first or second.
