The question

What is the ruling on a couple returning to each other with a new marriage contract after an undocumented khulʿ? And when does the waiting period (ʿiddah) begin: from uttering the khulʿ or from its documentation? Is it permissible for the wife to return to the marital home? And is it permissible to document a new marriage contract one month after documenting the divorce? And do the spouses have the right to return to each other?

The answer

It is permissible to renew the marriage contract through offer and acceptance between the wife's guardian and the husband in the presence of two witnesses. Documentation of the khul' is not a requirement. The waiting period (iddah) of the woman who undergoes khul' begins from the moment the husband pronounces the khul', and it ends with three menstrual cycles according to the majority of scholars, or with one menstrual cycle according to some scholars. It is permissible for the husband to marry his divorced wife during her iddah.
