If the sale is finalized, ownership of the house transfers to the buyer, and the price transfers to the seller. Any remaining amount of the price becomes a debt owed by the buyer, and it is impermissible for him to delay its payment.

If the contract includes a condition for rescinding the sale upon non-payment of the remaining price, then this condition is valid, and the seller has the right to rescind the contract and reclaim his house, provided he returns the full amount he received. This is based on the saying of the Prophet (peace be upon him): "Muslims are bound by their conditions, except for a condition that makes a lawful thing unlawful or an unlawful thing lawful."

If the contract does not include this condition, but the buyer's procrastination is proven, some scholars permit rescinding the contract to prevent harm to the seller. This is the choice of Sheikh al-Islam Ibn Taymiyyah and Ibn Uthaymeen. This is further supported by a court ruling to rescind or a warning issued by the court to the buyer.
