What is the legal ruling regarding a man who contracted his marriage to a woman while concealing his infectious disease from her, then after the wedding they decided to divorce, and he deemed it permissible for himself to take the gifts given to her without her consent?

A husband is not permitted to take anything from his wife's gifts except with her consent. This is because gifts either come to the wife from someone other than the husband, in which case he has no claim over them, or they come to her from the husband's side. If they are not part of the sadaq (dowry), the wife owns them immediately upon taking possession. If they are part of the sadaq or its accessories, she is entitled to half of it if divorced before consummation, and all of it after consummation. The husband's seclusion with his wife is considered equivalent to consummation, by which the wife owns all of the sadaq and its related entitlements.
