Do the guardians of the blood have the right to waive their claim and accept blood money after the death of the person infected with AIDS, or is the decision in the hands of the infected person before his death, especially if he lived for a period after the infection and decided not to pardon his killer, by analogy with the will of Ali ibn Abi Talib, may God be pleased with him?

Killing a soul that Allah has forbidden, intentionally and aggressively, is one of the gravest sins. Its perpetrator is liable to retribution (qisas). If a person intentionally injects another with the AIDS virus with the intent to kill, this is a heinous crime that necessitates qisas. The right to qisas or forgiveness belongs solely to the victim's guardian (wali al-dam). The victim's guardians may waive their right to qisas freely or in exchange for blood money (diyah) after the victim's death.
