Is it obligatory for a woman who has initiated a divorce from her husband while she is four months pregnant to wait until she gives birth and becomes pure from postpartum bleeding before she can remarry her ex-husband, or is it permissible for her to marry him during her pregnancy?

Khul' (divorce at the instance of the wife) necessitates a minor irrevocable divorce (baynunah sughra). The woman who seeks khul' is obliged to observe an 'iddah (waiting period) of one menstrual cycle, according to the most preponderant opinion, unless she is pregnant, in which case her 'iddah is until she gives birth. It is permissible for her first husband to remarry her and consummate the marriage with her while she is still in her 'iddah. What is forbidden is for her to marry someone else during her 'iddah. The majority of jurists hold the view that it is permissible for a man to marry a woman from whom he sought khul' while she is in her 'iddah.
