How many times has a divorce occurred between the couple, and is the wife still lawful for her husband after three divorce occurrences under different circumstances?
Divorce issues that entail rights for others are referred to the courts. Regarding the three divorces:
- The first divorce: It does not take effect if the compulsion reaches the degree of compulsion recognized by Sharia; otherwise, it does.
- The second divorce: Writing the word of divorce as a metaphor does not constitute a divorce unless intended, and its issuance in a state of anger does not prevent its occurrence unless anger overwhelms reason.
- The third divorce: It constitutes a divorce, even if it is a Khul‘ (divorce at the wife’s instance in return for compensation), as the majority of scholars believe that Khul‘ is an irrevocable divorce.
It is advisable to refer to the Sharia court, as the judge's ruling resolves disputes.
