If the deceased revived a barren land by cultivating it before his death, and the court ruled that this was valid and that he owned it, then there is no objection to the heirs benefiting from it; because it is considered part of his estate and is to be divided among them according to their shares. This is indicated by prophetic hadiths, among which are: "Whoever cultivates a land that belongs to no one, he is more entitled to it," and "Whoever revives a dead land, it belongs to him." The jurists have unanimously agreed that barren land is owned through revival.
