The question

Is it permissible for a wife to seek divorce from her husband who feigned religious commitment before marriage, then revealed his true self, differing with her religiously, treating her and her family poorly, being indifferent to her illness, masturbating, lying, and doubting her, given her family’s refusal for her to divorce and the husband’s desire for the marriage to continue?

The answer

Lenience in choosing may lead to dire consequences, so one should inquire about the suitor from trustworthy individuals. Whoever is remiss in fulfilling the rights of Allah may also be remiss in fulfilling the rights of his wife and treat her poorly. Allah has commanded kindness towards them, and the verse: {And live with them honorably} is evidence of the obligation to fully grant them their rights and refrain from harming them. If the husband's conduct does not improve, the wife has the right to seek divorce from him, and she is not obligated to obey her parents in remaining with him if he is causing her harm. It must also be noted that it is forbidden for a husband to suspect his wife without proof and to accuse her of immorality, for Allah says: {O you who have believed, avoid much [negative] assumption. Indeed, some assumption is sin.}
