What is the ruling on forcing a girl to marry someone without her consent?
A woman should not be forced to marry someone she does not desire, as this contravenes the command of the Prophet, peace and blessings be upon him, and leads to problems and instability in marital life. There are many proofs for this, among them: the hadith of the Prophet, peace and blessings be upon him: "The previously married woman has more right to herself than her guardian, and the virgin should be asked for her permission, and her permission is her silence." And the hadith: "A previously married woman should not be married until she is consulted, and a virgin should not be married until her permission is sought." They said, "O Messenger of Allah, and how is her permission?" He said, "That she remains silent." And the hadith: "The orphan girl should be consulted concerning herself; if she remains silent, she has given permission, and if she refuses, she should not be compelled." Among the scholars, some permitted the father or his guardian to compel the virgin specifically, and this is the view of the Malikis.
